NEW YORK – June 18, 2021 – Brown Rudnick partner and Chair of its Litigation & Arbitration Practice Group Michael Bowe was featured in an article in CNN Business entitled “Pornhub sued for allegedly serving nonconsensual sex videos.” The article discusses Bowe’s involvement in the case against MindGeek, the Canada-based parent company of Pornhub.

Pornhub and MindGeek are accused of knowingly profiting from videos depicting rape, child sexual exploitation, revenge porn, trafficking, and other nonconsensual content. Bowe and his colleague Lauren Tabaksblat, partner and Practice Group Leader of Brown Rudnick’s Litigation & Arbitration Practice Group, officially filed the case against MindGeek on June 17, 2021.

The article states, “The civil complaint alleges that Pornhub parent company MindGeek, one of the largest online pornography companies, is a "classic criminal enterprise" with a business structure created to monetize nonconsensual sexual content — allegations Pornhub denies.”

In an interview, Bowe stated that the online pornography industry "has operated like an old-school red-light district of commerce where rules that do apply and should be applied haven't been applied." The article reiterates from the complaint: "This is a case about rape, not pornography.”

The suit was filed on behalf of 34 alleged victims, of whom some share their hopes for justice not just for themselves, but for the countless victims who haven’t come forward.

In December, The New York Times contributor Nicholas Kristof published a column titled “The Children of Pornhub,” calling out the alleged nonconsensual and illegal content, which resulted in major credit card companies Mastercard, Visa, and Discover blocking their users from making purchases on Pornhub. Closely following this, Pornhub removed over 10 million videos from the site, which Bowe pointed out was "necessary but not sufficient, but what it does do is show you how big the problem is."

The CNN Business article states, “Bowe said he is hopeful that the case will be 'a watershed moment' for the online pornography industry, which 'simply hasn't been policed enough.'”
