Brown Rudnick’s market-leading commercial litigators secured a victory on behalf of their clients, the operators of the MGM Springfield and Encore casino resorts, in two class action litigations brought in connection with blackjack payouts at the MGM Springfield casino and the Encore Boston Harbor Resort and Casino.

On June 23, 2021, the Massachusetts Supreme Judicial Court endorsed the position of Brown Rudnick’s clients that the blackjack payouts offered at the two casinos fully complied with the Blackjack Rules promulgated by the Massachusetts Gaming Commission. The SJC affirmed the Superior Court’s order granting MGM’s motion to dismiss, and answered a certified question in Encore’s favor. 

The decision handed the Brown Rudnick clients a major litigation victory in a suit watched closely by the gaming industry and covered heavily by high-profile media nationwide. The suit had been filed by blackjack players who claimed they were entitled to higher payouts than the amount they received from the casino. Massachusetts’ top court ruled that the gamblers were aware of the rules when they placed their bets, and that the payouts offered by the two casinos complied with the Blackjack Rules. Associate Justice Scott Kafker wrote, "The plaintiffs lose this last bet. They should have quit while they were ahead." Read the decision here.
